• Eric M. Berman, P.C. was accused by the New York Attorney General and the Administrator for the New York State Courts of using process servers who intentionally failed to properly serve New York consumers with a Summons and Complaint.  See Pfau v. Forster & Garbus, et al.  In many of these cases, the process server claimed to be at several locations at once.  This practice, known as “sewer service” is a classic unfair debt collection practice that denies a debtor his or her day in court.  The Attorney General settled its claims against Eric M. Berman, P.C. in late 2010.
• Eric M Berman’s law office was sued by a consumer debtor alleging severe harassment and abusive practices.  On a daily basis for over two months, an employee from Eric M. Berman’s office reportedly called the plaintiff debtor and harassed her over the alleged debt.  The Berman employee repeatedly told the plaintiff that “we will get the money back no matter what” and “things will get really ugly for you if you do not pay back the money.”  The consumer’s lawsuit against Eric M. Berman, P.C. for unfair and deceptive collection practices was later settled.  See Wynne v. Stevenson, 2002 WL 31804497 (N.D. Ill. 2002).
